UPDATE 1/29/03 on the Montana Collies

Statement by AWCA President Jean Levitt, from Shelby, MT, in the courtroom

 Trial

On Wednesday, January 29, at 8:00 pm Mountain Standard Time, the judge declared a mistrial.  The jury had failed to reach a decision (5 voted Not Guilty, 1 voted Guilty).  The jury has been excused.  Prosecutor Merle Raph will file a written motion to consider another trial date.  According to defense attorney Albers, Ms. Harman is looking for about 70 adoptive homes.  There will be no plea bargain because even one count of animal cruelty will result in loss of AKC privileges.
