At 1 PM today the prosecutor, Toole County attorney Merle Raph, filed a motion in justice court requesting a new trial date and new discovery schedule.  Judge Janice Freeland has recused herself.  The new judge has not yet been selected.
 

Criteria for refiling is as follows:  probable cause exists that the charges are founded, that the defendants Athena Lethcoe-Harman and Jon Harman are attributable to the criminal act.  The prosecutor under his canon of ethics must believe there is sufficient evidentiary foundation to lead to conviction, according to Undersheriff Don Hale, of the Toole County Sheriffís Office.
 

Undersheriff Don Hale requests that only phonecalls, emails and faxes that will enhance the prosecutorial efforts be sent.
